Carrying concealed while traveling in an RV
«
on:
May 21, 2009, 10:54:05 PM »
I've just got to ask this and see if anyone can enlighten me.
This evening I came across someone who told me that since they were traveling in an RV, which is considered their home, they could carry a loaded firearm anywhere in the country. She has a concealed carry permit issued by Ohio and is now in Arizona. I told her I thought Ariz and Ohio did have a reciprocal agreement, so she was ok to carry in Ariz but she better not try that in California. She was adamant that she could legally carry concealed in California, and I felt it wise to not press the point.
I know what ya'll are going to say, but have any of you heard if an RV is somehow different?

I've never heard that. I doubt that it's true.

I would doubt she is legal in most states. I will do some asking around and see if I can come up with anything. I know in Utah the law just changed a week or so ago that allows you to carry concealed "in" a vehicle, and IMO, a motor home is legally a vehicle.

Interesting argument, but I don't think it would work. Looking at the NRA's summary for CA gun laws, I think it would be legal for her to have the gun loaded and in her possession while in the RV but not concealed w/out a permit. Page 3 under "CARRYING AND TRANSPORTATION IN VEHICLES" one of the exceptions to carrying a loaded handgun is "a person carrying a firearm while at home or place of business, including temporary residences or campsites". It then goes on to state that carrying concealed w/out a license is prohibited. I doubt CA recognizes Ohio CCW license like AZ does. I know they don't recognize AZ.

Here's the link to my NRA resource:
http://www.nraila.org/statelawpdfs/CASL.pdf
Disclaimer: #1. I'm no lawyer, #2. The summary is over 2 years old, #3. In CA, if she's rich and famous she'd get off even if it is illegal.

I have always heard that your automobile (RV, car, whatever) is an "extension" of your home, at least that is the way it is here in Georgia. You can, in Georgia, carry concealed in your car without a CCW permit. However, it's up to the state to decide on this if I am not mistaken. I always check, regardless of what I think, when I am traveling somewhere new in my car. Most everywhere I go observes my permit, but if it were somewhere new that I was traveling to, permit or not, it's always wise to check.

Thanks for your input, guys. I just naturally assumed she was either lying, or somehow deluded and therefore completely off base. But apparently, there is a certain amount of validity to this.
But I wonder if Jocko sleeps with one eye open or both!

This comes up on RV.net about every month or so ...
Most people assume that their RV is their home when traveling (we do) and therefore have someting. We carry a 20 gauge riot gun (Mossberg 500) and a Glock. Cutest little shotgun, smaller than the 12 ga version, 18" bbl, 3" chamber. I feel safe in confessing this since I don't plan on running across anyone here and a cop at the same time (heh, heh).
One story awhile back tells of a CHIP telling someone that they should have a gun in their RV, it's their home. Lots of crap over there however, so who knows.
BTW, in IL, we carry an unloaded weapon in our cars also, in a case, and a mag close buy. Does not need to be in the trunk and all that ... this has been thru the courts and some carry a copy of the article listing the case number and a brief of the outcome. Six seconds to safety we say (name of the artical often referred to).
I have not read the above linked PDF yet, but will ... thanks for that info.

So if your RV is like your home......
Do the police need a full on search warrant before searching and not just p.c.
like they do with your automobile??
I know (at least in Oregon) that it takes only p.c. to search your vehicle and even less to search you.

No idea, but I would let them in and take my chances, my dumb Swede defense would hold up better that way ...
Probably varies by state like everything else.

Seems to me that when you're driving, it's a vehicle and subject to applicable law; when it's in a campground, it becomes one's defacto home, and laws pertaining to a private home are en force.
But I've learned never to equate law with either logic or justice.

Thanks for all the info, RugerShooter. This spells things out pretty well, except for the States not listed.
This lady has moved on, and if she has any trouble I asked her to let me know. I'm sure Kalifornia will give her all the trouble she can handle.
